Title: Overview of cooperative law in Latin America
Abstract: El artículo apunta a ofrecer una visión general de los
	principales rasgos que caracterizan al derecho cooperativo 
	en América Latina y comienza brindando algunas precisiones 
	acerca de sus alcances y sus límites, poniendo especial énfasis
	en la distinción entre legislación cooperativa y derecho 
	cooperativo. Un esbozo de periodización histórica del desarrollo
	de la materia constituye la apertura de su tratamiento para 
	entrar seguidamente en la consideración de los lineamientos 
	comunes del derecho cooperativo regional en la que se incluye
	una referencia a la presencia del cooperativismo en las 
	constituciones de los países de la región para luego abordar los
	temas de mayor relevancia en cuanto a la relación entre el Estado,
	emisor de la legislación, y las cooperativas, a saber: la 
	constitución legal de estas entidades, la supervisión pública y el
	régimen de promoción, con un enfoque básicamente descriptivo aunque
	no exento del análisis crítico que las circunstancias ameritan. 
	Seguidamente se tratan ciertos aspectos particulares que en la hora
	actual pueden reputarse como especialmente significativos para 
	delinear su estado de situación. Básicamente se abordan los intentos
	de armonización de la legislación cooperativa regional que 
	representan el Proyecto de Ley Marco para las Cooperativas de América
	Latina, por una parte, y el Estatuto de las Cooperativas del Mercosur
	como forma de cooperación transfronteriza, por otra. Por último, se 
	trata acerca del notable crecimiento de las cooperativas de trabajo 
	asociado producido por la crisis económica y algunas manifestaciones 
	patológicas derivadas del fenómeno de la tercerización y la 
	consiguiente respuesta brindada por la legislación. Finalmente, se 
	concluye que un adecuado derecho cooperativo es una condición para
	el progreso de las cooperativas en la región.
Abstract: This article aims at giving a general outlook of the main features
	shaping the Cooperative Law in the Latin American Continent. It starts
	making some clarifications about the limits involved in the task and 
	emphasizing the distinction between Cooperative Law and Cooperative 
	Legislation. A brief history of the evolution of the subject in the 
	region marks the begining of the approach followed by the treatment of
	the common outlines of the regional Cooperative Law. The most relevant
	aspects dealt with are the reception of cooperatives in the national 
	constitutions of the different countries and then how legislation deals
	with the main aspects of the relation beween cooperatives and the State:
	the incorporation or legal constitution, public supervision and promotion.
	These aspects are considered from a descriptive approach but also from a 
	critical point of view taking into consideration the different situations 
	in the Continent. Afterwards, some particular aspects which are specially 
	relevant in the present time are dealt with. The tendency towards 
	harmonization of cooperative laws in the countries of the region through 
	the Project of the Framework Law for Cooperatives in Latin America and 
	the Statute for the Mercosur Cooperatives is tackled. Attention is also 
	given to the important growth of labour cooperatives in several countries 
	due to the economic crisis and the pehnomenon of the outsourcing in recent 
	years which brought about different legislative responses. Finally, the 
	conclusion is drawn that the progress of the cooperatives in the región 
	depends in a good measure of the existence of an appropriate Cooperative Law.
