Title: Does the regulation of agri-food cooperatives meet their needs? Study of the historical evolution and current situation of their regulation
Abstract: El presente artículo pretende realizar una revisión panorámica de la normativa cooperativa en lo que afecta a las cooperativas agroalimentarias y de su evolución histórica, en especial, 
	desde la Ley General de cooperativas.
	Comenzaremos por ver el origen de las cooperativas agroalimentarias y las distintas etapas por las que ha pasado su regulación, para centrarnos en el análisis del régimen jurídico actual 
	de esta clase de cooperativas. A diferencia de lo que sucede en otros ordenamientos en los que se dota a las cooperativas agroalimentarias de una norma específica que recoge su régimen 
	jurídico, en España la opción del legislador, tanto a nivel nacional como autonómico, ha sido incluirlas dentro de las leyes cooperativas generales. Así, la ley de cooperativas autonómica 
	o estatal correspondiente regula con detalle el régimen jurídico societario de las cooperativas: constitución, régimen económico, derechos y obligaciones de los socios, etc.; para después 
	distinguir las diferentes clases de cooperativas existentes, entre las que encontramos las agroalimentarias. Como consecuencia, solo contamos con uno o pocos más artículos destinados a 
	regular las particularidades que presentan las cooperativas agroalimentarias, lo cual es insuficiente. Entre esas especialidades nos encontramos las actividades que pueden llevar a cabo, 
	quién puede ostentar la condición de socio, ciertos aspectos contables, la regulación de secciones, mayor amplitud de operaciones con terceros no socios, la previsión estatutaria de un 
	voto plural, etc. Debe tenerse en cuenta que no todas las leyes cooperativas españolas regulan los mismos aspectos ni de igual forma, por lo que su análisis y comparación se convierten en 
	la razón de ser de este artículo.
Abstract: This paper aims to provide an overview of the cooperative regulations affecting agri-food cooperatives and their historical evolution, especially since the General Law on Cooperatives. 
	It will start by looking at the origin of agrifood cooperatives and the different stages through which their regulation has passed, in order to focus on the analysis of the current legal 
	regime governing this type of cooperative. Unlike what happens in other legal systems, where agri-food cooperatives are endowed with a specific regulation that covers their legal regime, 
	in Spain the choice of the legislator, both at national and regional level, has been to include them within the general cooperative laws. Thus, the corresponding regional or national cooperative 
	law regulates in detail the legal corporate regime of cooperatives: incorporation, economic regime, rights and obligations of members, etc.; and then distinguishes between the different types 
	of existing cooperatives, among which agri-food cooperatives can be found. As a result, there are only one or a few more articles aimed at regulating the special features of agri-food cooperatives, 
	which is insufficient. These special features include the activities they can carry out, who can be a member, some accounting aspects, the regulation of sections, greater scope for transactions 
	with non-member third parties, the provision in the bylaws for plural voting, etc. It should be borne in mind that not all Spanish cooperative laws regulate the same aspects or in the same way, 
	which is why their analysis and comparison is the raison d'être of this paper.
